Comedian Tracy Morgan Still Struggling After Car Crash

Tracy Morgan's attorney says the actor is having a hard time recovering from the June car accident on the New Jersey Turnpike that left fellow comedian James "Uncle Jimmy Mack" McNairof Peekskill dead.

Attorney Benedict Morelli tells The Star-Ledger newspaper that Morgan appears to be making progress, but it will be a month before he is assessed "cognitively." Morelli also says that Morgan relies on a wheelchair and it may be months before he can fully walk again.

Morgan broke his nose, leg, and several ribs in the six-car accident involving his limo bus. Comedian James McNair 62, of Peekskill, was killed and two other men were seriously injured. The bus was struck from behind by a Wal-Mart truck. The 35-year-old Kevin Roper has pleaded not guilty to one count of death by auto and four counts of assault by auto.

The report concluded that Roper had been on the job driving for about 13½ hours at the time of the crash. Federal rules permit truck drivers to work up to 14 hours a day, with a maximum of 11 hours behind the wheel. If Roper had continued to his final destination in Perth Amboy, he would have been pushing the 14-hour limit if he drove at the speed limit.

Morgan accused Wal-Mart of negligence in a federal lawsuit.
