Former Broadway producer and white-collar criminal Garth Drabinsky will not get an appeal with the Supreme Court of Canada, the Ottawa Citizen reports. The Canada Supreme Court announced Thursday that it would not hear Drabinksy's case.

Drabinsky was convicted for forgery and fraud in 2009 after he defrauded investors of Livent, Inc. of millions of dollars. He received a five-year sentence. Myron Gottlieb, Drabinsky's partner, also received a four year sentence. Ontario Supreme Court Justice Mary Lou Benotto made the ruling. Drabinsky failed to have his convictions overturned by Ontario's high court in September 2011. He filed his application to appeal to the Supreme Court in November 2011.

Livent, Inc., Drabinsky's Production Company, has since gone out of business. The comapny had produced such Broadway shows as Ragtime, Showoat, The Phantom of the Opera and Kiss of the Spider Woman.
