The retail giant Walmart responded to a lawsuit filed by comedian Tracy Morgan and three others over a deadly crash which occured in June, claiming that the plaintiffs were partially to blame because they were not wearing their seatbelts when they were hit by a Walmart truck.

The law suit says that Walmart was at fault because it should have known that the truck driver had been awake more than 24 hours before the crash. Check out Today's report below

Morgan broke his nose, leg, and several ribs in the six-car accident involving his limo bus. Comedian James McNair 62, of Peekskill, was killed and two other men were seriously injured. The bus was struck from behind by a Wal-Mart truck. The 35-year-old Kevin Roper has pleaded not guilty to one count of death by auto and four counts of assault by auto.
