So much for the post-racial USA that some politicos claim that the POTUS ushered in. The fact that the plaintiff brought suit and that the story was deemed newsworthy speak volumes. An added wrinkle is that the recipient in this case is a lesbian.

Alas, it's true we're hardly in a post-racial paradise. I think having a black president will help in the long run, but in the short, it only seems to incited racial panic among those who care about such things.

This lawsuit is not an example, however, at least not IMO. If the mother's claim that she and her partner have been advised to move to a more diverse town, why shouldn't the sperm bank pay for that?

The settlement would be for breach of contract, not a "black baby" penalty.

If this woman wants to go the legal path then she best start to remove emotions from the mix.

What did the contract say that she signed?
What were the potential liabilities that she agreed to (errors) that she may have waved with a casual stroke of the pen?
What type of insurance does this sperm bank have to cover professional errors?

This is also 2014...let's not try to go down the path that this kid is going to suffer not being fully accepted. Kids know what they are taught and if you are teaching that she has 2 mommies then you can teach that she was wanted regardless of what society thinks.

It is unfortunate that there was a mixup but life happens.
Teach this child love.

Um...the simple fact is that it's not what she paid for. Calling her a racist (did you even read the article) is just a "blindly jump on the politically correct bandwagon" jump and makes no sense. It's not like she thought she was getting the chicken lomein but when it arrived, she was shocked to see it was pork. This IS actually kind of a big deal and the sperm bank NEEDS to be sued to ensure that they don't make this kind of mistake again. But did you bother to read the part where she said " while she and her white partner love their "beautiful, obviously mixed-race baby girl..." or was using the word "negro" to describe her "obvious racism" more attnetion grabbing?

There are MANY factors that go into choosing a donor, not just race. You choose based on ethnicity, height, hair color, eye color, education, hobbies, blood type, RH factor, certain genetic traits. The wrong race is only the tip of the iceberg when it comes to not getting what she paid for.

I don't get where you think that I or any other poster has labeled the mom a racist. My beef is primarily with the online news source that came up with that inflammatory choice of headline. I've been an ethnic minority in the US for 50 yrs so by now I've come to terms with MSM, Hollywood, and Broadway's tendencies to default to white as normative. And concerning the use of the word "negro", I can think of at least 4 languages in which it's an adjective that denotes a black object or attribute.

It's still my conviction that the US does not have a race problem per se but rather a color problem like other parts of the Americas. Simply put, it's about who is fair-skinned enough to pass for white and who has no other choice but to fall on the other side of the divide by default like this woman's child. In this case, it's a woman who I'd like to think understands the struggle many of us face to avoid being marginalized due to an accident of birth. It's not always obvious that a person is a lesbian by appearance alone, nor is it possible to gauge someone's economic station in life with certitude by their attire alone. But, there are folks who can spot a fly in the buttermilk a mile away. And those folks seem to be a cause for the mom's concern.

I haven't seen a copy of the contract between the parties so I have no way of discerning or divining whether or not the defendant is negligent.

I hope the sperm bank pays a lot of money to this couple. This has nothing to do with racism, the sperm bank made a huge mistake, and they need to pay for that. Women going to the sperm bank are very specific and picking your baby's race is huge. There is nothing wrong with wanting a baby that is Caucasian, or any other race for that matter. I'm sure they will love their child unconditionally, but they deserve compensation over this.

For those that say "she didn't get what she paid for" What was her objective in going to a sperm bank? To have a child. Regardless of them screwing up, Think 12 to 21 years from now when that child looks up these articles. How does that look to the child?

The thoughts he/she will keep them in therapy. My parents didn't want me, I was a mistake, I was an object. I may have been taken care of but it wasn't genuine.

You can say its not racism but it's certainly not love.

A parent should certainly be able to get a 12 to 21-year-old to understand that you can love someone while at the same time deal with the practical aspects of a contract breech. The human brain is made to hold complex thoughts like that. Of course they should be suing.

I agree that there's nothing wrong with an individual or couple wanting a designer baby. And if the defendant is found negligent, I hope the state throws the book at the operator(s). But, Kavana is onto something here.

That child did NOT ask to be brought into this world. And the mere thought that the mom would be so concerned with the community's acceptance of her daughter is slightly unsettling to me, race notwithstanding. What child wants to one day discover that he or she was a burden for the parent(s)?

Let me attempt to put this into perspective. There are still plenty of parents who absolutely do not want their son or daughter to be born (or turn) gay. If that was not the case with anyone on this message board then consider yourself fortunate. I'm acquainted with several members of the GLBTQ community who at some point during adolescence were either expelled from their homes or beaten up by a parent and/or siblings due to their orientation. What if those parents had been able to determine the child's orientation at birth? Suing God was not an option?

The first will have to be addressed in her pleading or her suit should be thrown out. The second is for the bank to put forward in its pleading if there is such a claim to be made. The third is the sperm bank's and their insurance coverage plan's problem; not hers.

I have no opinion on whether this lawsuit has merit or not. But I'm not going to cast racist aspersions on this woman for bringing the lawsuit without knowing more facts.

Unless one thinks that people going to a sperm bank don't have the right to contract for the racial background of their sperm donor - and I doubt many are ready to make that demand - then you can't have it both ways. If the bank didn't follow through on its promises then the bank might well be liable for breach of contract.

I've heard of a mixed race couple who specifically wanted a black baby. The reason was that the black partner, a woman, didn't want to be thought of as the nanny when she was rolling the baby around Park Slope. Now irrespective of how some of us might view this particular arguably self-conscious about class concern, the fact is that the couple wanted a child of a certain race, in this case a black child. If the sperm bank had delivered a white donor's sperm, would we be so quick to call a lawsuit against them by the parents racist?

I highly doubt it.

While we are on the subject, this case strikes me as a perfect illustration of how little people understand law and how it works and how ignorance about legal process leads to misguided claims about people involved in legal cases all the time.
