Please select and review a witness deposition, which are available at the Equity office reception desk. Actors should be prepared to take the stand as a witness and answer questions based on their selected deposition. Bring headshot and resume.

The contract salary ranges from $269.00 - $773.00 depending on the role assignments. There is no health payment.

BREAKDOWN

Kirkland & Ellis LLP has an intensive, year-round training program for its litigation associates. This program is known as the Kirkland Institute for Trial Advocacy (KITA). As part of the KITA program, our associates engage in a two-day jury trial. This year’s mock trial will be based on the Consolidated Department Store Case file. Approximately 70 Actors will be cast for the 2017 mock trial program.

WITNESS PROFILES


Margaret Clarke/Matthew Clarke
: Manager, Consolidated Department Stores

- Received emergency phone call from security guard at store that he had seen about six inches of standing water in the sub basement to the store and that the water was rising.

- Recalls that a few years ago the sub basement experienced a minor flooding problem. She contacted Department of Public works and spoke to Mr. O’Leary who was responsible for tunnel system. Mr. O’Leary said that a few 'punctures' of the tunnel system had occurred, but there was nothing to worry about. Received a letter from City regarding sealing off the entrances to the tunnel. We did not seal off the entrance to the tunnel because the risk of anything but minor flooding seemed minimal.


Paddy Bauler/ Patricia Bauler
: Engineer, Department of General Services, City of Nita

- Received a videotape (in February) from a Nita Cable Co. employee showing a leak in the tunnel, but without the exact location indicated. (Flood occurred in April.) Notified one of his supervisors about the reported leak and that he would personally check it out.

- Spent a few weeks hunting for leak and found it on March 13. He then informed the Supervising Engineer, Department of General Services personally.

- He wrote a memo regarding the situation, but never sent it until after the flood. However, he insists he informed the necessary parties verbally and pushed for immediate repairs of the tunnel breach to the proper supervisors.

- Disgruntled. Fired from his position and is contesting his discharge. Feels he's ‘‘taking the fall’’ for politically connected bureaucrats.


Ralph Bushel/Rachel Bushel
: Professor Emeritus at Nita State University in Civil Engineering

- Civil Engineer Expert for Consolidated Department Stores.

- B.S. in Civil Engineering from Carnegie Mellon; Ph.D. from Rensselaer Polytechnic University in 1935.

- Feels both the City and Dredge & Dock failed in their duties to identify underground structures that could be affected by pile placement in a new location; that Dredge & Dock failed to follow general practice in the location of utilities, boundaries, structures, etc.; and, that once informed that the tunnel had been breached, the City of Nita failed to take the necessary steps to seal off the damaged portions.


John O’Leary/Jacqueline O’Leary
: Director, Department of Transportation

- B.S. in Engineering in 1966 and obtain a master’s degree in Engineering from Nita University in 1971.

- Responsible for maintaining all facilities within the City that support the transportation infrastructure. He oversees the repair of streets, bridges and any City owned structures or property that involve transportation.

- Was fired by the Mayor because of the flood. He says that the disaster was not his fault because jurisdiction over the tunnel was never clear since the Mayor refused to designate which department was ultimately responsible for the tunnels.


McKenna Coughlin/Mary Coughlin
: Project Manager, Dept. of Transportation, City of Nita

- In charge of the project to drive pilings into the bed of the Nita River and entire Wells Street Bridge pilings project.

- Informed by Northwest's site foreman that two of the new pilings had to be installed in slightly different locations than the originals. Gave telephone authorization for the proposal and plans to go forward. Also asked for, but never received written confirmation of the plans. Had no further contact with Northwest and assumed the problem had been solved without relocating the pilings.

- Shortly after the flood, was fired by the City of Nita for inadequate supervision of the pilings installation.


George Sweet/Georgia Sweet
: Professor at Nita Institute of Technology in Civil Engineering

- Civil Engineer Expert for City of Nita.

- B.S. in Civil Engineering from Georgia Tech; Ph.D. from Duke University in 1945.

- Feels both Northwest Dredge & Dock failed to conduct their activities in accordance with the normal practices for all excavation projects; that any requests to deviate from the written contract should have been made in writing, with written permission from the City of Nita; and that failure to do so constituted a breach contract.


Peter Hopkins/Paula Hopkins
: Foreman, Northwest Dredge and Dock, in Charge of Wells Street Bridge Project

- Joined the company twenty years ago, after high school, as a laborer. Rose through the ranks, acquiring virtually all his work knowledge through on the job experience.

- Ran into problems installing the last two pilings and informed the Northwest project manager regarding the situation. Was directed to 'get the job done' and deal with the City.

- Asked the City Engineer on the site if the pilings could be relocated. City Engineer passed request to McKenna Coughlin, who gave telephone authorization to do so a few days later.

- Coughlin asked for a written request to change the job specifications, but Hopkins got the impression that this was only a formality; a letter was never sent. The old pilings were then removed and the new pilings relocated and installed.


Lauren Noyes/Lawrence Noyes
: Northwest Dock & Dredge Project Manager

- Licensed and certified engineer with over twenty years of experience in major marine construction projects.

- Was told by Hopkins that pile clusters had to be replaced around Wells Street Bridge. Felt that the City would have notified him if there was going to be a problem relocating the pilings.


Jori Outlander/Joe Outlander
: Professor Emeritus at Nita University in Civil Engineering

- Construction Expert Retained by Northwest Dredge & Dock

- B.S. in Civil Engineering from Columbia University; Ph.D. from Cornell in 1939.

- Feels that City of Nita authorized movement of the piles without sufficient planning to determine that it could be safely executed; and that it is reasonable for Northwest Dredge & Dock to expect to have one official point of contact for contract interpretation.
