VidAngel Refutes Disney's False Claims in New Court Document

These four Hollywood studios have taken legal action in an effort to undercut the 2005 Family Movie Act and prevent VidAngel from lawfully empowering parents and families to filter content on modern devices in their homes.

Yesterday, Disney filed a declaration in Los Angeles District Court claiming that VidAngel is not in compliance with a preliminary injunction recently issued by Judge Andre Birotte, Jr. In response, VidAngel has filed its own declaration addressing VidAngel's efforts to comply.

Facts and Timeline:

  • VidAngel filed an ex parte application a week ago asking to stay enforcement of the preliminary injunction pending VidAngel's appeal of it.

  • Disney raised the issue of the stay of the injunction in a hearing on VidAngel's antitrust case on December 19th. Judge Birotte commented that he was considering VidAngel's motion to stay the preliminary injunction.

  • The four studios suing VidAngel submitted their opposition last Thursday and filed a supplemental declaration of their attorney, Kelly Klaus, last night.

  • The Court has not yet ruled on the stay request but has noted that it raises substantial issues.

  • If the district court denies the stay, VidAngel plans to appeal the motion to stay to the 9th circuit (which will decide VidAngel's appeal on preliminary injunction).

  • If VidAngel is unsuccessful in getting a stay, it will take down the plaintiffs' movies.
