Tracy Morgan is still fighting to recover from injuries sustained from the six-car summer car accident he was involved in this past June.

"He's fighting to get better, and if there's a chance for him to be back to the Tracy Morgan he once was, he's going to try to do that," Morgan's lawyer Benedict Morelli said today in court, according to The Hollywood Reporter. "But we just don't know because of the severity of the injuries that he sustained and the fact that he had such a severe brain injury."

Morgan broke his nose, leg, and several ribs in the six-car accident involving his limo bus. Comedian James McNair 62, of Peekskill, was killed and two other men were seriously injured. The bus was struck from behind by a Wal-Mart truck. The 35-year-old Kevin Roper has pleaded not guilty to one count of death by auto and four counts of assault by auto.

Wal-Mart previously claimed that the accident was partly Morgan's fault. A scheduling conference for Morgan's lawsuit against the mega-corporation were held today in New Jersey.

In response to Walmart's claim, Morgan released the following statement in October: "After I heard what Walmart said in court I felt I had to speak out. I can't believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."
