Does the US fed gov't have the authority currently to regulate tuition rates at state public college & universities?

I ask as a non-attorney.  I vividly recall several prominent educators, conservatives, and states pushing back against Common Core due to their belief that it was federal overreach.  Check out a page from Connecticut Against Common Core.  The Department of Education is one of the most embattled cabinet-level agencies at the moment with Ted Cruz going so far as to call for its abolishment.  See his Five For Freedom hit list.  This election has raised Ted Cruz's profile nationally as well as within the Senate.  He's both young and ambitious enough to withstand a loss at either the party convention or in the general election.

 

I'm not accusing Bernie Sanders of any sleight of hand.  However, some of his supporters are glossing over the detail that his proposed College for All Act would require that states opt-in, after enactment of the law at the federal level.  See Summary of Sen. Sanders’ College for All Act.  I do like the provisions for student loan re-financing.  Nevertheless, I'm hard pressed to see how the Sanders' College for All Act would ever see the light of day even if the Democrats should claim majorities in both chambers of Congress this fall. States-rights fanatics in governor mansions, legislatures, and high courts nationwide would have a field day with Bernie's proposal.

 

Many of you will recall that at one point at least 20 states chose not to expand their Medicaid programs under the Affordable Care Act (ACA aka ObamaCare).  See States Rejecting Medicaid Expansion Under the Affordable Care Act.  Then, juxtapose the list with the 2012 electoral college map.

Bernie's plan for college is dependent upon cooperation from states, including those currently uder the control of GOP governors and/or legislatures.  In other words, it will never happen.  Hiillary has been pointing this out, but the media has been ignoring it.

Much like the states where people can't afford the ACA, I am afraid it will just never work due to republican opposition.
